It was a dropped meatball off of 4-year-old Kayla Garcia's Subway sandwich and her slow pace walking home one day three months ago that prompted a horrific discipline session resulting in her death, the child's mother told a judge Thursday. Melanie Garcia wailed, shouted and occasionally spouted expletives at her ex-boyfriend's lawyer as she recalled her daughter's last day of life, testifying at a hearing in which co-defendant Matthew Carrillo asked to be released from jail for lack of probable cause.

Garcia, 21, and Carrillo, 23, were both charged with injury to a child causing serious bodily injury in May after Kayla was taken to the hospital with a head injury, bruises all over her body including her genitals and a burn on her thigh. Neither adult has been indicted yet, but prosecutors have indicated that capital murder charges would be considered.
