A California judge is weighing the fate of a boy who, at age 10, shot his neo-Nazi father in the head while he was sleeping. Joseph Hall, now 12, is being tried for first degree murder in the killing of Jeff Hall, 32, who defense lawyers say was an abusive parent who routinely beat and kicked his son. Riverside Superior Court Judge Jean Leonard is hearing the case without a jury. He alone will decide whether the boy knew what he was doing was wrong and whether the murder was premeditated. If found guilty of premeditated first-degree murder, Joseph could be imprisoned until his 25th birthday for the May 2011 shooting.
