Justice Timothy Brewer said the police case is that Harwood, 66, had been in an all-day drinking session with Stewart Paul Kingi before the latter wet himself.
Harwood got into a "physical altercation" with Kingi before pushing him off the balcony of a second-storey Auckland apartment with the help of another man.
Justice Brewer said police allege "the victim was clinging to the balcony" and Harwood "prised his fingers off and he fell to his death".
